Who We Serve

Beneficiaries of the Fuca NFT Private Digital Trust are the Named Parties and successors in interest — individuals who hold a rightful claim to settlement proceeds, securities, and financial instruments but who may have been denied knowledge of their entitlements due to misclassification, non-disclosure, or the simple passage of time.

The Executor's Office exists to serve these individuals. Every action the office takes — from claims assessment to declaration filing to asset management — is directed toward a single outcome: making the beneficiary whole. The office's fiduciary duty runs exclusively to the beneficiaries, not to any administrative body, intermediary, or third party.

Core Beneficiary Services

Claim Establishment

Guiding beneficiaries through the process of establishing their identity as the Named Party or successor in interest — verifying age of majority, confirming survival status, and preparing the affidavit that formally asserts their claim to restoration.

Rights Education

Clear, transparent communication about what the settlement memorial contains, what rights and interests the beneficiary holds, and what the restoration process entails — because informed beneficiaries are empowered beneficiaries.

Ongoing Protection

Continuous fiduciary oversight that protects beneficiary interests throughout the trust's lifecycle — from initial restoration through asset management, distribution, and generational transfer of wealth.

Beneficiary Rights Under the Trust

Usufruct & Beneficial Use

Beneficiaries hold usufruct rights — the right to beneficial use of settlement proceeds and assets while legal title is held and protected by the trust. This structure, recognized under New York estates law, ensures the beneficiary receives the economic benefit while the trust provides fiduciary protection.

Full Disclosure

Every beneficiary has the right to complete transparency: knowledge of all assets held on their behalf, the status of any pending claims, accounting of distributions, and access to the settlement memorial and supporting documentation through the secure member portal.

Restoration & Wholeness

Under the Made Whole Doctrine, beneficiaries are entitled to full restoration — legal title, beneficial interests, and financial instruments returned to their rightful position as if the misclassification never occurred. No partial remedies; complete wholeness.

Self-Sovereign Identity

Each beneficiary receives SSI credentials — decentralized, member-controlled digital identity that allows them to verify their ownership and entitlements independently, without relying on any centralized authority for proof of who they are or what they own.

The Beneficiary's Journey

From first contact to full restoration, beneficiaries are supported at every stage:

Discovery & Assessment

The Executor identifies the beneficiary's claim, evaluates the settlement memorial, and confirms the Named Party's status. If the beneficiary was previously unaware, the office acts as next friend to initiate the process on their behalf.

Declaration & Restoration

The declaration packet is filed, the Registrar annotates the record, and the Named Party's title is perfected nunc pro tunc. The beneficiary is formally recognized as a living successor with full legal capacity and standing.

Asset Transfer & Management

Recovered assets are placed under trust custody, tokenized on-chain, and made accessible through the member portal. The beneficiary gains full visibility into their holdings and their value.

Distribution & Empowerment

The Executor distributes per the settlement terms — assigning usufruct, equities, and beneficial interests. The beneficiary transitions from being represented by the office to full self-sovereign control of their own rights and assets.

Continuity & Generational Protection

The trust ensures continuity of asset management across generations, protecting family wealth from creditors, disputes, or poor financial decisions. By avoiding probate through trust-based administration, the trust prevents delays, disputes, and the risk of assets reverting to the state through escheat.

Beneficiary services extend beyond the individual to the family — ensuring that the restoration achieved today creates a lasting foundation for future generations. The trust's blockchain-secured records provide permanent, tamper-proof documentation that protects these rights in perpetuity.
